What is your responsibility as a property owner when someone is injured on your property?
This question was discussed at length at our Extension Agricultural Law Conference on Nov. 17. According to Peggy Hall, legal educator, Agricultural and Rural Law Program, The Ohio State University, the issue is important to farmers and other land owners.
Land owner responsibility (and, consequently, liability for monetary damages) is determined by the type of visitor to your property, as well as the type of hazard the visitor encounters.
Negligence is the legal basis for premises liability. Negligence is when a landowner breaches the legal “duty of care” owed to a property visitor. The legal duty of care owed a property visitor depends on the type of visitor.
