Ex-auction owner must pay debts

WASHINGTON – The USDA ordered Gary Fogle, former owner of Barnesville Livestock Sales Co. of Barnesville, Ohio, to pay money owed to livestock consignors and to stop using sale funds for personal use.

Fogle is no longer affiliated with the Barnesville livestock auction.

The initial complaint filed by USDA’s Grain Inspection Packers and Stockyards Administration in August 2000 was amended April 24, 2002.

It charged that Fogle allegedly failed to properly use and maintain Barnesville’s custodial account, issued insufficient funds to pay sellers and consignors of livestock and failed to pay proceeds to livestock consignors.

Fogle must make timely deposits into the custodial account, maintain the custodial account in agreement with regulations, not use funds from consigned livestock for personal purposes, and pay amounts due to the consignors of livestock.

These violations of the Packers and Stockyards Act resulted in Fogle’s suspension.

The default decision was issued Nov. 1 and the decision became final Jan. 8.
